End User License Agreement

Introduction

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Tavla ("we", "our", or "us") for the use of the Tavla mobile application ("App"). By downloading, installing, or using the App, you agree to be bound by the terms of this EULA.

License Grant

We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, strictly in accordance with this EULA and any applicable terms from the platform through which you obtained the App (e.g., Apple App Store, Google Play Store).

License Restrictions

You agree not to:

• Copy, modify, or distribute the App or any portion of it
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Rent, lease, lend, sell, sublicense, or otherwise transfer the App to any third party
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any unlawful or unauthorized purpose
• Use the App in any way that could interfere with, disrupt, or negatively affect the App or its servers
• Use automated scripts, bots, or other means to access or interact with the App

Ownership

The App and all rights, title, and interest in and to the App, including all intellectual property rights, are and will remain the exclusive property of Tavla. This EULA does not grant you any ownership interest in the App, only a limited right to use the App in accordance with this EULA.

User Content

You retain ownership of any content you submit through the App, including workout data, nutrition logs, and profile information. By using the App, you grant us a limited license to use, process, and store this content solely for the purpose of providing and improving the Service.

Third-Party Services

The App may integrate with third-party services such as Strava, Apple HealthKit, and others. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the content, privacy practices, or terms of any third-party services.

Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TAVLA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Health and Fitness Disclaimer

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or health condition.

All fitness plans, nutrition guidance, and AI coaching provided through the App are for informational and educational purposes only. You should consult with a qualified healthcare professional before starting any exercise program or making changes to your diet. You use the App and follow its recommendations at your own risk.

Termination

This EULA is effective until terminated. We may terminate this EULA at any time if you fail to comply with any term of this agreement. Upon termination, you must cease all use of the App and delete all copies from your devices. Sections regarding ownership, disclaimers, limitation of liability, and governing law shall survive termination.

Updates and Modifications

We may from time to time update, modify, or improve the App. Such updates may be required for you to continue using the App. We may also update this EULA from time to time. Your continued use of the App after any changes to this EULA constitutes acceptance of the updated terms.

Governing Law

This EULA shall be governed by and construed in accordance with the laws of the jurisdiction in which Tavla operates, without regard to its conflict of law provisions.
